What Custody Rights Do Fathers Have?
Parents, including those men who were unmarried to the mother at the time of birth (I guess we know where babies come from), are entitled to custody of their children - however, Family Code section 3010 doesn't say what that custody must look like. This section really speaks to uninvolved parents who've effectively abandoned their offspring.

CUSTODY OF CHILDREN
DEFINITIONS AND GENERAL PROVISIONS
Family Code Section 3010
(a) The mother of an unemancipated minor child and the father, if presumed to be the father under Section 7611, are equally entitled to the custody of the child.
(b) If one parent is dead, is unable or refuses to take custody, or has abandoned the child, the other parent is entitled to custody of the child.
